By accessing or using the My Fertility Lifestyle website (myfertilitylifestyle.com) or any of our telehealth services, you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use our website or services.

These Terms of Use apply to all visitors, patients, and users of our platform. We reserve the right to update these terms at any time, and your continued use of the site following any changes constitutes your acceptance of the revised terms.

2. Our Services

My Fertility Lifestyle Pty Ltd ACN 699 253 793 provides telehealth consultations and subscription-based fertility and hormonal health services delivered by registered Australian medical practitioners.

Our services include:

• Online patient intake and health history assessment
• Telehealth consultations via video (Microsoft Teams) or telephone
• Personalised treatment plans developed by our medical team
• Prescription management and coordination with pharmacy partners
• Ongoing monthly review and plan adjustment

All medical services are provided by practitioners registered with the Australian Health Practitioner Regulation Agency (AHPRA) and are subject to applicable Australian healthcare laws and regulations.

3. Not an Emergency Service

My Fertility Lifestyle is not an emergency medical service. Our telehealth platform is intended for non-urgent fertility and hormonal health consultations only.

If you are experiencing a medical emergency, call 000 immediately.

Do not use this platform to seek advice for acute or life-threatening conditions. If you are unsure whether your situation is urgent, please contact your local GP, hospital emergency department, or call 000.

4. Eligibility

To use our services, you must:

• Be at least 18 years of age
• Be located in Australia at the time of consultation
• Provide accurate and complete information in your patient intake form
• Have a valid email address and be able to receive electronic communications

Our services are available to Australian residents only. We are unable to provide prescriptions or medical advice to patients located outside Australia.

5. Patient Responsibilities

By using our services, you agree to:

• Provide truthful, accurate, and complete information about your health history, medications, and symptoms
• Notify us promptly of any changes to your health status or medications
• Follow the advice and treatment plan provided by your treating doctor, or inform us if you choose not to
• Attend scheduled consultations or provide reasonable notice of cancellation
• Use prescribed medications only as directed and not share them with others
• Inform your regular GP or other treating practitioners about any treatments prescribed through My Fertility Lifestyle

Providing false or misleading health information may result in inappropriate treatment and may put your health at risk. We reserve the right to suspend or terminate your access to our services if you provide false information.

6. Subscriptions and Payments

Our services are provided on a monthly subscription basis. By subscribing, you authorise us to charge your nominated payment method on a recurring monthly basis.

Billing — Subscriptions are billed monthly in advance. Your subscription renews automatically unless cancelled.

Cancellation — You may cancel your subscription at any time via the cancellation page at myfertilitylifestyle.com/cancel-subscription. Cancellation takes effect at the end of your current billing period. You will retain access to services until that date.

Refunds — We do not offer refunds for partially used subscription periods. If you believe a charge has been made in error, please contact us at [email protected].

Price changes — We will provide at least 30 days' notice of any changes to subscription pricing. Continued use of the service after the effective date of a price change constitutes acceptance of the new pricing.

Payments are processed securely by Stripe. We do not store your full payment card details.

7. Prescriptions and Medications

Prescriptions issued through My Fertility Lifestyle are provided at the sole discretion of your treating doctor. A consultation does not guarantee that a prescription will be issued.

Prescriptions are issued in accordance with Australian prescribing guidelines and the clinical judgement of our practitioners. Our doctors may decline to prescribe if they determine it is not clinically appropriate.

Medications are dispensed by our pharmacy partners and delivered to your nominated address. Delivery times may vary. You are responsible for ensuring your delivery address is correct and that someone is available to receive temperature-sensitive medications where applicable.

Do not alter your prescribed dosage without first consulting your treating doctor.

8. Intellectual Property

All content on this website — including text, images, graphics, logos, and software — is the property of My Fertility Lifestyle Pty Ltd ACN 699 253 793 or its licensors and is protected by Australian and international copyright law.

You may view and print content from this website for your personal, non-commercial use only. You must not reproduce, distribute, modify, or create derivative works from any content on this site without our prior written consent.

9. Limitation of Liability

To the maximum extent permitted by Australian law, My Fertility Lifestyle Pty Ltd ACN 699 253 793 and its directors, employees, and practitioners are not liable for any indirect, incidental, special, or consequential loss or damage arising from your use of our website or services.

Our liability for any claim arising out of or in connection with our services is limited to the amount you paid for the subscription in the month in which the claim arose.

Nothing in these terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by the Australian Consumer Law that cannot lawfully be excluded or limited.

10. Privacy

11. Termination

We reserve the right to suspend or terminate your access to our services at any time if:

If we terminate your access for reasons other than your breach, we will refund any prepaid subscription fees for the unused portion of your current billing period.

These Terms of Use are governed by the laws of Queensland, Australia. Any disputes arising from these terms or your use of our services will be subject to the exclusive jurisdiction of the courts of Queensland.
